- Your use of this website and these terms and conditions are subject to English law and the exclusive jurisdiction of the English courts.
- Some descriptions may include brand names, company names, corporate identities or trademarks. No brand names, company names, corporate identities or trademarks may be used without the express permission of Active Consultancy or the company concerned.
- Images may not be copied, reproduced or published without the permission of Active and/or the correct licensing. Images are illustrative only and may not accurately reflect the items listed
- Claiming prizes
- Once a prize has been claimed it is non-refundable and non-changeable.
- Claims for experience prizes will be fulfilled via an online booking form. An email containing a link, voucher number and validation code will be emailed within 5 working days of receipt of your order.
- Claims for gift items or high street vouchers, gift cards or e-codes, will normally be despatched within 5 working days of receipt of your order but please allow up to 28 days. Participants can call the support hotline if they wish to check availability prior to ordering.
- Claims for holiday prizes will be fulfilled via a booking form, sent by email along with the holiday itinerary, within 5 working days of receipt of your order.
- Risk and title will pass to the customer upon delivery. Active can take no liability for any lost, stolen or damaged prizes once responsibility of ownership has passed to the customer at time of delivery.
- Unless stated otherwise, all prizes are designed for over 18s. Other age restrictions may apply for certain activities. Please see the terms on each reward for details of any age requirements.
- Active reserve the right to change the range of prizes, and/or the description, content, options, locations or price of the prizes, without notice.
- The information provided regarding the prizes is based on enquiries made by Active and is believed to be accurate but Active makes no warranty or representation in respect thereof.
- Claiming a prize shall be deemed as acceptance by you that Staubli and Active shall not be liable for any loss, illness, injury or death incurred unless due directly to negligence by us. When you claim a prize, Staubli and Active will only be liable for our own negligence or breach of obligations. Staubli and Active are not liable for the acts or omissions of any third party supplier, which are subject to their terms and conditions.
- Prize Fulfilment
- Active is not a travel agency or retailer and all prizes, products, travel trips and experiences are fulfilled via third party suppliers. Once a claim has been fulfilled in full, or a trip is fully booked, and any relevant documents have been provided Active’s responsibility in terms of fulfilment is complete.
- Active will endeavour to use reputable third-party suppliers and agents when fulfilling all prizes.
- Staubli and Active accept no liability whatsoever in respect of any loss, damage or injury, caused or related in any way to any prize provided or any experience or trip undertaken.
- Some prizes may only be available on specific dates. Where applicable, prizes exclude travel and/or attendance on or over Christmas, New Year, Easter and bank holiday weekends, unless stated otherwise.
- For experiences, please note that restrictions (where given) are only offered as a guide. Some individual centres may have restrictions that are not included within the proposal.
- Anyone under 18 years of age participating in an experience must be accompanied by an adult. Other age restrictions may apply.
- Any deadlines by which a prize must be claimed, or an experience or trip must be booked or undertaken, will be advised at the time of claiming. It is the responsibility of the recipient to provide any requested details in time. If such details are not provided within the timeframe set out, the prize will be forfeit.
- All prizes are subject to availability. Should a prize become unavailable at time of order Active reserve the right to offer the current version, alternative brand/model or a prize of equivalent value and specification.
- Once claimed, all prizes are subject to the terms and conditions and cancellation policy of the supplier providing the prize, which are available upon request.
- Staubli or Active shall not be held responsible if a prize cannot be fulfilled due to war, strikes, industrial action short of a strike, import or export embargo, lock-outs, accidents, fire, blockade, flood, natural catastrophes or other obstacles over which Active has no control. Active shall not be held responsible for any loss or damage which may be incurred as a result of such failure.
- Supply of claimant/traveller details and the go ahead to claim a prize/book a trip will be deemed confirmation and acceptance of the prize and Active’s terms and conditions outlined herein and as previously supplied and on any promotional literature connected with a promotion or scheme.
- Physical Gifts
- All physical gifts include delivery to the delivery location specified.
- Despatches will be made by an appropriate carrier and may require a signature on delivery. Any time or date specified for deliveries are an estimate only.
- Any failed deliveries as a result of incorrect address supplied by the claimant will be charged to the claimant for the cost of return and redelivery of the item at prevailing rates.
- Active advise that where it is evident that goods are damaged, then recipients should not take delivery of such damaged goods. For incomplete delivery or goods damaged in transit, please retain a copy of the delivery documentation, and all original packaging, and notify Active within 24 hours, who will advise you on the return’s procedure.
- If the item is found to be damaged or faulty after delivery, please ensure you retain all original packaging and contact Active who will advise of the correct procedure of return. If the item is returned for any other reason, you may be charged for the cost of return and redelivery of the item at prevailing rates.
- Active will provide warranty terms offered by the manufacturer in respect of all products. Manufacturers' guarantees are for domestic and private use only and recipients must notify Active of any warranty claim within a reasonable time after the defect or failure.
- Gift cards & e-codes
- Gift cards and e-codes cannot be exchanged for cash. Each retailer or company operates its own policy on spending gift cards & e-codes including whether partial spends can be made, or change issued and in the case of some e-codes any remaining balance may be banked in an online account to redeem against future purchases. Gift cards which are defaced, altered or cancelled may not be accepted.
- The expiry date on gift cards and e-codes vary depending on the retailer and Active takes no responsibility to changes to the terms and conditions of individual gift card and e-code issuers.
- Active can take no liability for any lost, stolen or damaged gift cards or e-codes once responsibility of ownership has passed to the customer at time of delivery.
- Active must be notified by the customer within 90 days of the order date if a gift card or e-code has not been delivered. Active are unable to investigate lost gift cards or e-codes after this time period has elapsed.
- In the event that any retailers or companies whose gift cards or e-codes we provide be placed in either administration or receivership there is no obligation on Active to replace or exchange any previously issued, unspent gift cards or e-codes.
- Recipients should refer to the gift card or e-code received for any retailer specific terms and conditions.
- Experiences
- Experience prizes are valid for 12 months from date of issue. You must take your experience before the expiry date stated.
- Experiences are provided on a booking basis in accordance with centre availability. The duration of the experiences vary and are dependent on the type of activity chosen. Certain dates and/or packages offered by the supplier may not be included within the prize and therefore may be excluded from booking availability.
- Some experiences may be weather dependent.
- Some experiences may have to be taken as a group or with other members of the public.
- Some experiences are only available on specific dates.
- Travel costs to and from the experience location are not covered and therefore will be at the participant's own expense.
- All UK experiences are supplied with personal accident cover. However, you may wish to consider taking out your own private insurance cover.
- Holidays
- Holidays are valid for 12 months from date of issue of the booking form, and you must travel within this 12 month period.
- For most holidays and weekend breaks, travel on or over the Christmas, New Year periods and Bank Holidays is excluded. Some trips may also only be available on set dates or during a specific seasonal period, as specified in the holiday description.
- Flights are from London unless specified otherwise. Travel from other UK airports will be accommodated where possible but may incur additional fees.
- Trips including flights, and booked as ‘a package’, will be ATOL bonded through the applicable third-party supplier or agent and an ATOL certificate will be provided, however trips where flights are booked separately may not be ATOL protected. It is the responsibility of the traveller to be aware of what bonding is provided. Upon accepting the trip and confirming final booking arrangements the traveller accepts the trip in full including bonding conditions.
- If car hire is included then it is based on a standard package and is restricted to drivers over 25 years old. Drivers over the age of 21 may be permitted but additional fees will apply.
- Once the date for your holiday has been agreed and booked, should you change or cancel your booking for any reason cancellation fees will be payable. Any cancellation after the booking is made may incur fees of up to 100%. This includes, but is not limited to, traveller schedule clash or work commitments, ill health, flight cancellation by the airline due to strike, political action or terrorism, mechanical failure or environmental condition.
- Travel costs to and from the departure airport are not covered and therefore will be at the participant's own expense.
- Unless stated otherwise, holidays are designed for over 18s. Other age restrictions may apply for certain activities, please see the terms on each holiday for details of any age requirements. All travellers aged under 16 years are required to travel with a parent or legal guardian. Travellers aged between 16 to 18 years will require written permission from their parent or legal guardian before they can travel.
- Flights are subject to changes in airport taxes and fuel surcharges levied by the airlines until the time of ticketing.
- Travellers are expected to be in good health and fit to travel and it is the traveller’s responsibility to declare any health-related issues or additional requirements including but not limited to wheelchair facilities.
- It is the traveller’s responsibility to ensure they have a valid passport and meet any applicable visa or entry requirements in place at the time of travel.
- Active provide travel insurance as standard with all travel prizes. Details of the insurance policy and levels of insurance cover can be provided upon request and necessary emergency contact information relating to the insurance will be provided to all travellers prior to departure.
- It is the traveller’s responsibility to check that participating in any trip or activity does not compromise or invalidate any existing personal assurance, insurance, life policies etc. that any of the party travelling may hold. All travellers should ensure that travel insurance taken out on their behalf by Active does not negate any of their own personal insurance.
- Modifications to terms and conditions
- Staubli and Active reserve the right to modify these terms and conditions at any time and without notice by posting the amended terms and conditions on this site. You agree to read these terms and conditions regularly so that you will be aware of any changes and your continued use of the website will mean that you agree to the changes made. If you do not agree to the changes, you should notify Staubli and Active accordingly and your account will be closed.
